can you sell an ar-15 upper in California to say a friend or neighbor with out an FFL license?
i know they can be shipped straight to your home from the internet or a magazine so does this mean you can sell them with out the FFL middle man?

The AR15 lower is the registered firearm…not the upper. The AR15 upper is nothing but parts as far as the BATF and most states are concerned. So you can sell or ship the upper pretty much anywhere in the U.S. and to that person’s front door. Now being that you’re located in California I would make sure that upper complies with their laws. I’m talking about barrel length and non bayonet lugs etc.
As long as the upper receiver doesn’t have a serial number, you should be able to transfer it without a license. Of course, in the People’s Republic of California, things may be different. Ask some of the local gun shops.

Nearly every AR-15 manufacturers: DPMS, Olympia, Bushmaster, Colt etc etc do not ship parts to California.
You never need to have a FFL license. This is a license to run a gun shop. That would be the same as buying a Ford Dealership instead of an Escort to commute to work.
In California – barrels that are threaded, have a bayonette lug, etc etc are illegal. If your upper is ‘street legal’ in California there is nothing wrong selling it – they are just parts – not a complete rifle.
