Concealed and open carry laws I’m informed of, and I know that a state can, if it chooses to, require gun dealers to perform background checks (the National Instant Background Check System, or something along those lines), but I recall reading somewhere that it was ruled unconstitutional for the federal government to require states to mandate these checks. Is that true? If so, in which states do people NOT need to pass a background check to buy at a dealership? Or does other firearms legislation (1934 and 1968, et al) bypass this by making Federal Firearms licenses mandatory and, therefore, enabling back-door blanket background check requirements in all states? Such confusion. x_x

You cannot purchase a firearm from a FFL dealer without a National Instant Criminal Background Check (NICS), this is a Federal Law. Some, but very few states allow you to show your Concealed Carry Permit in lieu of a background check, and that is only because the background check to get your CC permit in much more complete than the (NICS) background check. Sales of firearms by private sellers are allowed to proceed without a background check unless required by state law. These regulations remain in place at gun shows, where no special leniency is granted to licensed sellers, and no additional requirements are placed upon private sellers.
You will not be sold a gun, rifle or any fire arm legally without a background check. Otherwise, felons, illegal aliens, and people with a police record would be able to purchase a gun.
You may have read some article about what some people feel about background checks, but just because some people don’t agree with a background check does not mean you don’t have to have one before you purchase a gun legally.
It completely depends on the type of gun. Nerf guns, for example, can be purchased with minimal scrutiny.
Many states issue gun licenses for which you need a one-time background check. After that, there is no waiting period and no background check for any guns you want to purchase.
Also, many states exempt "private purchases" from their regulations (other than having to be 21 to own a handgun), so you would not need any paperwork or background check unless dealing with an FFL.
