<content:encoded><![CDATA[<p>Concealed and open carry laws I&#8217;m informed of, and I know that a state can, if it chooses to, require gun dealers to perform background checks (the National Instant Background Check System, or something along those lines), but I recall reading somewhere that it was ruled unconstitutional for the federal government to require states to mandate these checks. Is that true? If so, in which states do people NOT need to pass a background check to buy at a dealership? Or does other firearms legislation (1934 and 1968, et al) bypass this by making Federal Firearms licenses mandatory and, therefore, enabling back-door blanket background check requirements in all states? Such confusion. x_x

<p>ok so it says this:</p>
<p>Handguns</p>
<p> * Permit to purchase handgun? No<br />
    * Registration of handguns? No<br />
    * Licensing of owners of handguns? No<br />
    * Permit to carry handguns? No*</p>
<p> * It is unlawful to sell or transfer a firearm capable of being concealed on one&#8217;s person to anyone who has been convicted of a felony or adjudicated a delinquent minor for conduct that would constitute a felony if committed by an adult. It is an affirmative defense that 10 years or more has elapsed since the unconditional discharge on the prior offense.</p>
<p> * It is unlawful to knowingly sell or transfer a firearm to a person whose physical or mental condition is substantially impaired as a result of an intoxicating liquor or drug, or to sell a firearm to a person less than 18.<br />
&quot;Jsatt&quot; &#8211; this is from the official gun laws in Alaska &#8211; &quot; Registration of handguns? No &quot;</p>
<p>so apparently in my state, registration of a hand gun is not required

<content:encoded><![CDATA[<p>As we all know gun laws differ widely from state to state. In some of the more gun friendly states &quot;unlicensed dealers&quot; (read a guy with a trunk full of weapons) are permitted to ply their wares at gun shows. These individuals will sell whatever they may have at the moment to anybody who is willing to plunk down the asking price. No paperwork and in most cases no id required.<br />
I have seen on several occasions signs advertising this fact. &quot; No paperwork, no id, no waiting.)<br />
Now this does present several problems, but two critical ones immediately leap to mind.<br />
1. The obvious one is this sort of venue provides prohibited persons with ease of access to weapons.<br />
2. As a purchaser one should be extremely suspicious as to the origins of the weapon.<br />
And yes I know that one can easily purchase a firearm out of the classifieds in a great deal of cities as well as the occasional dark alley or back room of some unscrupulous charlatan.<br />
And yes that would be impossible to regulate, but gun shows should not be open to anybody but licensed dealers who play by the rules.<br />
Your thoughts on the matter?<br />
Ok, lets first address the phrase &quot;unlicensed dealer&quot;<br />
There are people who travel from city to city to sell their &quot;collection&quot; of firearms. And while the do not have an ffl nor keep a record book, they are dealers in every sense of the word.<br />
The make a portion, or all of their living from doing this activity.<br />
Very similar to someone who buys up a whole house of junk and has a perpetual yard sale to make a profit. The point I am trying to make here is that we need to do everything possible to keep prohibited people from gaining access to firearms.<br />
And this would be a step in the right direction.<br />
Ok. Before you form a posse, grab rope and set off in search of a tall oak tree, let me just say one thing here,,,,,,<br />
I am not in cahoots with the gun grabbers, nor am I lobbying for this type of action. Just a casual question, one that I have heard of several occasions.<br />
But I think we should take every precaution we can to prevent guns from getting into the hands of prohibited people.<br />
Jeez&#8230;who knew this would cause such a hullabaloo.

<content:encoded><![CDATA[<p>On March 14th, I plan on attending my first gun show at the Gwinnett County Fairgrounds in Georgia. I know how much a new .17 and .22 caliber rifle is since I own multiple rifles in various calibers from .17HMR to .44 Remington Magnum. I have all the licensing and documentation required to own and fire a firearm in my area. What I want to ask his, how much could I expect to find a good quality .17 or .22 caliber rifle for? I plan on using them for backyard plinking, light pest control, say up to rabbit or squirrel, and as a cheaper firing range alternative to more expensive caliber rounds. I am not sure if it is a dealer show, a private owner show or a mixed show. Is it possible to do some bargaining? Or if I think the price is OK should I just buy it? Thanks.

I am a non-resident citizen, actually from NJ, do they usually ask for anything more than a driver&#8217;s license to do a background check? I am making a trip back from there soon so any store near interstate 390 or 86 is good too. I would prefer to buy from a large retail store, like Dick&#8217;s sporting goods, etc. I plan on taking in unloaded in my trunk back to NJ, so that would be legal under federal law. The only gray area is that technically the dealers is supposed see a New Jersey Firearm Purchaser ID even if I buy out-of-state, but I heard a lot of places outside NJ don&#8217;t know or don&#8217;t care. I only need the ID to buy it in NJ not to possess one in NJ. Anyone have any experience with buying out-of-state?

<content:encoded><![CDATA[<p>Barack Obama supports handgun registration and licensing&#8230; </p>
<p>I know that the NRA believes people should be unimpeded and unregulated on gun ownership. I disagree. I do not object to the lawful use and ownership of firearms, but I do think it is entirely it appropriate for the state to monitor it. Too many of these guns end up in the hands of criminals even though they were originally purchased by people who did not have a felony. I&#8217;ll continue to be in favor of handgun law registration requirements and licensing requirements for training. [Chicago Defender, 7/5/01]<br />
        &#8212; http://factcheck.barackobama.com/factcheck2/2007/12/<br />
and more&#8230;<br />
The package closes the Firearm Owners Identification (FOID) card loopholes which resulted in the shooting out in Melrose Park. We&#8217;re eliminating 17 specific assault weapons. There is no reason why anybody should need an assault weapon to protect themselves or their family,&#8217; Obama said. &#8216;We&#8217;re limiting handgun sales to one a month. We&#8217;re calling for handgun registration. It&#8217;s very hard right now to track whether or not a felon has turned in his weapons or if he has a FOID card because we don&#8217;t know how many weapons he has purchased. [Chicago Defender, 2/20/01]<br />
        &#8212; http://factcheck.barackobama.com/factcheck2/2007/12/<br />
Opposes civilian concealed carry </p>
<p>I am consistently on record and will continue to be on record as opposing concealed carry.<br />
        &#8212; Mendell, David, &quot;From Promise to Power&quot; (2007), p. 251. </p>
<p>I am not in favor of concealed weapons. I think that creates a potential atmosphere where more innocent people could (get shot during) altercations.<br />
        &#8212; Pittsburg Tribune-Review (April 2, 2008).<br />
[Obama] backed federal legislation that would ban citizens from carrying weapons, except for law enforcement. He cited Texas as an example of a place where a law allowing people to carry weapons has &quot;malfunctioned&quot; because hundreds of people granted licenses had prior convictions.<br />
&quot;National legislation will prevent other states&#8217; flawed concealed-weapons laws from threatening the safety of Illinois residents,&quot; Obama said.<br />
        &#8212; http://www.icadp.org/page236.html (Citing David Mendel, Chicago Tribune, February 20, 2004) </p>
<p>Opposes possession of most semi-automatic rifles </p>
<p>Obama has stated the government needs to permanently reinstate an &quot;assault weapons&quot; ban.<br />
(Obama Calls for Permanent Assault Weapons Ban to Combat Inner-City Violence, Associated Press [via Fox News] [July 15, 2007] and http://www.cnn.com/ELECTION/2008/issues/issues.gun.html)<br />
(McCain voted against the 1994 crime bill that contained an &quot;assault weapons&quot; ban [see the latter link].) </p>
<p>Voted for a federal ban on most military surplus ammo </p>
<p>Voted in 2005 to classify all Full Metal Jacket ammo in the following calibers as armor-piercing (since they are capable both of being fired from a handgun and of penetrating Kevlar bullet-resistant vests): </p>
<p>223 Remington<br />
308 Winchester<br />
Soviet 7.62&#215;39<br />
Source: http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=109&amp;session=1&amp;vote=00217 </p>
<p>Opposes protecting firearms manufacturers from lawsuits due to the misuse of their products. </p>
<p>In July, 2005 Obama voted against S. 397 that passed by a wide margin (65-31) and became law in October, 2005. This act prohibits &quot;civil liability actions from being brought or continued against manufacturers, distributors, dealers, or importers of firearms or ammunition for damages, injunctive or other relief resulting from the misuse of their products by others.&quot; </p>
<p>Probably supports local handgun bans </p>
<p>The campaign of Democratic presidential hopeful Barack Obama said that he &quot;believes that we can recognize and respect the rights of law-abiding gun owners and the right of local communities to enact common sense laws to combat violence and save lives. Obama believes the D.C. handgun law is constitutional.&quot;<br />
&#8212; http://www.sportsmenforobama.org/content/view/34/ (Citing James Oliphant and Michael J. Higgins, &quot;Court To Hear Gun Case,&quot; Chicago Tribune, 11/20/07).<br />
(See http://www.scotuswiki.com/index.php?title=DC_v._Heller for background on the case of District of Columbia v. Heller, before the Supreme Court, that will decide the constitutionality of a civilian handgun ban in Washington, D.C.)<br />
Opposed the nomination of Supreme Court justices John G. Roberts Jr. and Samuel A. Alito Jr. </p>
<p>Recent Supreme Court justices John G. Roberts Jr. and Samuel A. Alito Jr. were instrumental to a favorable Second Amendment ruling in the Heller case mentioned above. Obama voted against the nomination of Roberts and Alito. (McCain voted for the nomination of both justices.) (Roberts&#8217; roll call vote, Alito&#8217;s roll call vote) </p>

<p>The above quotes are all OBAMAS own words! How can he be pro gun???<br />
STOP drinking the socialist koolaid!

<content:encoded><![CDATA[<p>The other night I got pulled over b/c the officer said my taillights can’t be tinted. Make a long story short he arrested me for DUI(blew a .10) and confiscated my fully licensed firearm. As he was going through my pockets he pulled out my Percocet painkillers ( 20-5mg). They were tied up in a plastic bag. I told him I had a prescription for them but didn’t have the container with me. Which is 100% true. He charged me with DUI, felony drug possession, and are trying to take my gun away. I had no idea you couldn’t have your prescription pills outside its container. Truth is I don’t keep the bottles b/c I don’t trust the people who come in and out of my house b/c I run a business out of my home. I’ve had my pills stolen before. I know how bad this looks. I think they are going to make it look like I’m a drug dealer. Plus, I’m a 6-5 260 pound 27yr old black guy driving a BMW 745LI. What do you think I should do, and what do you think is going to happen? Serious advice only please.

<content:encoded><![CDATA[<p>I certainly believe not.Gun control helps to reduce the crime rates associated with firearms.It&#8217;s common sense.Civilian cannot own a firearm unless if the individual him/herself has a very(i mean VERY) solid reason to why they need guns such as a farmers or shepperds to avoid wild animals from ruining their crops or killing their livestocks. They gonna need special license and training according to the type of firearm they want to used. This is how the system works down here in Malaysia.Only a police officer, military personnel on duty, security guard and a some other few government law enforcement agency are allowed how have guns while on duty. They cannot bring back the gun home after they finnish their shift. They must be kept it in a special safety locker. The gun law here is pretty tight actually and the logic that applies here is that any civillian that owns a gun without a license is also a full-time criminals.robbers, drug dealers, smugglers, kidnapers etc.So what do you guys think?
