If you are legally married to someone in prison are you able by Texas state law to get a license to carry a firearm?

You are not a felon are you? If not, why not?
When your husband gets out of prison, he may not be able to stay in a house with a weapon.
I would think a background check would be run on you – since you are the one applying for the permit to carry a firearm. Your husband in prison would not be an issue, until he gets out. Then if he is caught in possession of a firearm he could be arrested.
I can’t find anything in the Handgun manual denying the request, but if released on parole your husband can not come home without a violation.
