Montana firearms freedom act (effective oct 2009)
The law exempts firearms made and kept in the state of Montana from United States federal firearms regulations. It also has no requirements for registration, background checks or dealer licensing.

The ATF sent letters to all FFL dealers and said they will not tolerate it and federal law is above their law.

Do you think the ATF will raid gun stores possessing these weapons?

I read this law was written to purposely create a battle for overall state rights VS the federal government.

What do you think?
The law also states that Article II, section 12, of the Montana constitution prohibits government interference with the right of individual Montana citizens to keep and bear arms.
If the federal government goes against the Montana constitution will Montana leave the union? what will happen over their?

It’s an honest question.

There were 1,074,757 gun purchases through licensed FFL dealers last month. 9,076,205 for this year. Over a million a month.

And how do you gun banners propose getting all of them? And how do you explain that gun crime rate has been going down over the past couple decades? And why is it that the crime rate is higher in cities and state where regulation is strict compared to states with more lax laws?

And can you answer this one simple question:

Can you demonstrate one time or place, throughout all history, where the average person was made safer by restricting access to handheld weapons?

I don’t expect people to try and answer that question. Or answer it directly.
Only 17% of weapon that are taken from the drug cartels are traced back to the US.

The ATF has said the 90% of the guns that are given to them from Mexico to trace are from the US. But that is about 18% of the total guns recovered and most are handguns. The other 72% don’t have American markings or American serial numbers.
Therefore that 72% is never given to the ATF to trace because it is obvious they don’t come from America.
And before someone calls it out my mistake its 82% of the total seized guns that are known to not be American.

I am wondering if the Federal Firearms Law(s, there are many) Loophole which states (and this may be pieced together from different laws, but I believe this is true:)

"Sales or Transfers of Firearms between Private Individuals that are not Licensed FFL Holders, namely those that are not Actively Engaged in the Business of selling or dealing firearms, may transfer or sell a firearm to a Private Individual that is not an FFL holder that is also not Actively Engaged in the Business with no provision of a record check required."

This, I believe, is what got a lot of people in an uproar because the idea was that "Anyone can go to a Gun Show and buy whatever they want." The reality is, however, that 95% of the people at a Gun Show are licensed FFL holders, and ATF and Police are there to enforce those sales, and process Form 4437 for those sales from FFLs….

… However, gun people also pointed out that making laws for Gun Shows was silly, since the above "Cash-and-carry Private Non-FFL Citizen to Private Non-FFL Citizen" sales were legal in the parking lot.

I want to know if this loophole is still in effect. If it is, I have a ray of light for my situation, and have a way to (as legally as possible) achieve my goal of my 2nd Amendment Right, without breaking (one of the) Federal laws. There are many, but as far as I know, this clause has not yet been closed.

I also wondered at one point if it only applied to sales of Long guns… I know someone knows the answer to that too.

I thank you for reading my other posts. I am glad you understand what I am getting that. I even tried to allude to it in my posts that there are different Federal laws, and that this one I have questioned is how I will have to obtain my weapon. I do also know that getting caught with it is my butt. I thank you for seing this, and I wanted you to know I appreciate your, the first poster’s, and all the other person’s info.

I must wrap it up with this: NJ is trying to remove the rights of people -nationwide- to own firearms. I can not let my rights be stramrolled. I have joined the NRA today, and will be pursuing expungement, rights restored, and a possible Constitutional challenge to the gun laws of NJ. As far as me possessing a Firearm, I am about to go to a Gun Show in Texas. It appears I do not even need ID for the private sales.

I’m wanting to start a small pawn shop in a small Alabama town. There was a pawn shop in town for 13 years, but the owner had to retire due to health issues. I want to fill the gap the previous owner has left. My question is, how do I survive while trying to get it started?

I know I need a county business license, state pawn license, and Federal Firearms License (FFL) from the ATF. I need a building, pawn software, inventory, etc. I think I have all that figured out. But the FFL takes 2 to 6 months to get processed from what I hear, and to be able to submit the FFL to be processed, I have to list where the store is going to be and talk to the local sheriff, etc. So basically, I need to go ahead and get a building, start paying rent on it, and wait months on the FFL to get approved before I can start doing business? That, to put it mildly, aint no good.

Also, I’m still working on the numbers, but it’s hard to figure out how I’m going to make ends meet when I can’t accurately predict sales numbers until after I open the business. I have about 15k saved up in cash, plenty of credit (very good credit score and no debt except a home), 0 mortgage payment, typical utilities, etc. The rent on the store I want to put the pawn shop in is 0/month. I’m looking at about 10-15k of initial expenses just in furnishing the store, having a decent inventory of merchandise and guns, and buying the pawn software and paying all my 1st month’s bills. Then it will be around 00/month for business expenses as a minimum, and around 00/month for bills I have to pay at home, as a minimum. I’m no economics major, but I’m having trouble figuring out how I’m going to be able to make 00/month any time soon at a pawn shop. That’d mean I would need to pawn out nearly ,000 in loans every month. Help me out guys, how can I make this dream come true?

i recently just sold a shotgun online to an out of state resident. i know by law modern firearms have to be shipped to a federally licensed firearm dealer in that state. but its an antique 1915 shotgun, does that still qualify as modern. would it be legal to send right to there residence? i looked on the ATF website but couldn’t find any information.
