Do you have to have a FFL to sell ammunition?

I am helping out a business for an outdoors site and I need to know if you need a Federal Firearms license to sell ammunition

Does the Federal Loophole still exist? I believe it does… but I am not certain…?

August 4th, 2010 admin 5 comments

I am wondering if the Federal Firearms Law(s, there are many) Loophole which states (and this may be pieced together from different laws, but I believe this is true:)

"Sales or Transfers of Firearms between Private Individuals that are not Licensed FFL Holders, namely those that are not Actively Engaged in the Business of selling or dealing firearms, may transfer or sell a firearm to a Private Individual that is not an FFL holder that is also not Actively Engaged in the Business with no provision of a record check required."

This, I believe, is what got a lot of people in an uproar because the idea was that "Anyone can go to a Gun Show and buy whatever they want." The reality is, however, that 95% of the people at a Gun Show are licensed FFL holders, and ATF and Police are there to enforce those sales, and process Form 4437 for those sales from FFLs….

… However, gun people also pointed out that making laws for Gun Shows was silly, since the above "Cash-and-carry Private Non-FFL Citizen to Private Non-FFL Citizen" sales were legal in the parking lot.

I want to know if this loophole is still in effect. If it is, I have a ray of light for my situation, and have a way to (as legally as possible) achieve my goal of my 2nd Amendment Right, without breaking (one of the) Federal laws. There are many, but as far as I know, this clause has not yet been closed.

I also wondered at one point if it only applied to sales of Long guns… I know someone knows the answer to that too.

Thanks, I surely do appreciate the info.

PS: I am asking so that I can be as informed as possible, some of you know my previous posts. I am not the type to give up. Thanks.
* Added info, 2 minutes ago: This info is directed to John T. Mr. John T, I tried to mail you but you do not allow that…

I thank you for reading my other posts. I am glad you understand what I am getting that. I even tried to allude to it in my posts that there are different Federal laws, and that this one I have questioned is how I will have to obtain my weapon. I do also know that getting caught with it is my butt. I thank you for seing this, and I wanted you to know I appreciate your, the first poster’s, and all the other person’s info.

I must wrap it up with this: NJ is trying to remove the rights of people -nationwide- to own firearms. I can not let my rights be stramrolled. I have joined the NRA today, and will be pursuing expungement, rights restored, and a possible Constitutional challenge to the gun laws of NJ. As far as me possessing a Firearm, I am about to go to a Gun Show in Texas. It appears I do not even need ID for the private sales.

& No Loophole. I am pro-gun. JC

CHO SEUNG-HUI "If not for me, for my children……"?

August 2nd, 2010 admin 17 comments

This was unfortunately a horrible tragedy that could have been prevented if his medical condition had been properly reported to federal firearms licensing… even though it’s required to do so.

But.. one thing that struck me me odd was in his ramblings CHO siad … "I will no longer run, , if not for me or my children…. for my brothers and sisters …. *****"

What do you think he means by children?

He was not known to even have a real girlfriend… his roommate said he had an imaginary girlfriend. The news media has not picked up his reference to his children. Nor have they even mentioned if he had a brother or sister. But he certainly did not have children. If you believe he was speaking metaphorically… to what end

Question about the legal process of buying/owning a rifle?

July 27th, 2010 admin 5 comments

I’m interested in purchasing a rifle from Armalite that requires a Federal Firearms License – I am not a current gun owner (nor have I ever been, despite spending over 6 years in the Army), and looking over the FFL categories (dealer, manufacturer, importer and collector), I don’t technically fit into any of those, except collector, but the gun I want to purchase does not meet the criteria for being classified as a collectible weapon. (The weapon in question is an M15A4 carbine in .223/5.56mm.) Can anybody detail the process I would have to go through to be able to purchase this weapon from Amralite? Or would it be easier (or cheaper/sensible) to try to procure one from a gun shop? Any help at all in trying to figure this out would be appreciated.

is this a good ak buy and is classic arms reliable?

Expungement of foreign offence in USA?

July 22nd, 2010 admin 1 comment

I’m convicted of committing a Civilian Offence which involves Domestic Violence in Norway. The Civilian Offence was however NOT defined as a crime by the court of law. I was senteced to serve 43 hours of Community Service. After 3 years the Civilian Offence has been expunged from my record where speeding tickets are usually registered. I’ve been to the United States, Japan, Russia, China and England after the incident and have had no problem obtaining tourist visas. But if I am to apply for American Citizenship after living in the United States as an law obiding, working Engineer, would I be disqualified or have my chances reduced to obtain an American Citizenship? And if I so did obtain it, would I have my Norwegian expunged offence be registered in the American registers as NON expunged? Does it mean that my offence would have to be expunged by the american court of law as well in order to be valid as expunged in the United States? As for applying for Federal Firearms License, enlisting the army and purchasing guns, would I be disqualified even though my Civilian Offence is expunged in Norway?
BLCOHEN5 is an instant winner, unless someone can convince me otherwise.

Gun show Loophole – Selling Weapons?

July 14th, 2010 admin 21 comments

Help me understand the Gun show loophole. From what I understand, an individual can sell their weapons at a gunshow without running a backround check. Does this also mean they can sell their weapon without needing to go through a person/business with a Federal Firearms License to complete the transfer?

In other words, can I sell a Glock Pistol to somebody who says, "Hey, I’ll give you 0 bucks for that Glock", and just take the money, give them the gun and call it a day? No paper work, no checks, no license, no nothing? Is that the Gun Show Loophole?
